双重载重线特别条款(SPECIAL CLAUSE ON DUAL LOAD LINE)
1. 适用前提与证书要求(Applicable Premises and Certificate Requirements)
1.1 本条款仅适用于[巴拿马/利比里亚/中国香港等]特定船旗国注册,且合法持有两套有效载重线证书(含检验报告)的船舶。
1.1 This clause shall only apply to ships registered in specific flag states such as [Panama/Liberia/Hong Kong, China, etc.], which legally hold two sets of valid load line certificates (including inspection reports).
1.2 船东保证两套载重线证书均经船级社年度检验并签署,符合《1966年国际载重线公约》及船舶注册国相关法规要求。
1.2 The Owner warrants that both sets of load line certificates have been annually inspected and signed by the classification society, complying with the International Load Line Convention 1966 and relevant regulations of the ship's flag state.
1.3 船舶启用任一套载重线时,另一套证书须经船检机构当场封存后交由船长妥善保管;航行期间仅可展示当前使用的证书及对应检验报告。
1.3 When the ship uses either set of load lines, the other set of certificates shall be sealed on-site by the classification society and then properly kept by the master; only the currently used certificates and corresponding inspection reports may be displayed during navigation.
2. 标志管理与展示规则(Mark Management and Display Rules)
2.1 两套载重线标志已按船级社要求勘划完成:最深吃水标志采用焊接方式固定,第二套标志采用切割或冲压工艺制作。
2.1 Two sets of load line marks have been surveyed and painted in accordance with the classification society's requirements: the maximum draft mark is fixed by welding, and the second set of marks is made by cutting or stamping.
2.2 船舶舷侧仅可清晰展示当前启用的一套载重线标志,其余标志须用与船壳同色的油漆完全覆盖,严禁多套标志同时可见。
2.2 Only one set of currently used load line marks may be clearly displayed on the ship's side; the other marks shall be completely covered with paint of the same color as the hull, and it is strictly prohibited to display multiple sets of marks simultaneously.
2.3 因标志勘划不规范、展示不清或未按要求覆盖导致的港口处罚、滞期等损失,由船东承担全部责任。
2.3 The Owner shall bear full liability for losses such as port penalties and demurrage caused by irregular survey of marks, unclear display, or failure to cover marks as required.
3. 切换流程与触发条件(Switching Process and Trigger Conditions)
3.1 出现以下情形可触发载重线切换:①挂靠港口有载重吨/吃水限制;② 航线途经高风险海域(如风浪密集区、复杂航道);③ 气象条件恶化需增强储备浮力;④ 其他经双方书面确认的合理情形。
3.1 Load line switching may be triggered in the following circumstances: ① The calling port has restrictions on deadweight tonnage/draft; ② The route passes through high-risk sea areas (such as stormy areas, complex waterways); ③ Deteriorating meteorological conditions require enhanced reserve buoyancy; ④ Other reasonable circumstances confirmed in writing by both parties.
3.2 切换前须经船级社验船师现场核验,确认闲置标志已有效覆盖、新标志清晰可辨后,方可完成切换操作。
3.2 Before switching, on-site verification by the classification society's surveyor is required. The switching operation can only be completed after confirming that the idle marks have been effectively covered and the new marks are clearly distinguishable.
3.3 切换完成后,船长须立即将切换时间、原因、对应载重标准等信息记入航海日志,并由船东在24小时内书面告知承租人。
3.3 After the completion of switching, the master shall immediately record the switching time, reason, corresponding load standard and other information in the logbook, and the Owner shall notify the Charterer in writing within 24 hours.
4. 载货量调整与费用结算(Cargo Quantity Adjustment and Fee Settlement)
4.1 两套载重线对应具体载货基准如下:① 标准载重线:最大吃水[X]米,对应载重吨[X]DWT;② 增强储备浮力载重线:最大吃水[X]米,对应载重吨[X]DWT。切换后须按新基准调整实际装货量。
4.1 The specific cargo benchmarks corresponding to the two sets of load lines are as follows: ① Standard load line: maximum draft [X] meters, corresponding to deadweight tonnage [X]DWT; ② Enhanced reserve buoyancy load line: maximum draft [X] meters, corresponding to deadweight tonnage [X]DWT. The actual loading quantity shall be adjusted according to the new benchmark after switching.
4.2 允许出租人在[5%-10%]的载货量波动范围内,根据货物密度、舱容情况灵活调整配载,实现满舱或满载的合理适配。
4.2 The Owner is allowed to flexibly adjust the stowage within the range of [5%-10%] fluctuation in cargo quantity according to the cargo density and hold capacity to achieve reasonable adaptation of full hold or full load.
4.3 费用划分:① 因承租人要求切换载重线(如临时变更航线)导致载货量减少的,产生的亏舱费由承租人承担;② 因不可抗力(如突发气象灾害)需切换的,运费按实际载货量结算,双方互不追究额外责任。
4.3 Fee division: ① If the cargo quantity is reduced due to the Charterer's request for load line switching (such as temporary route change), the resulting dead freight shall be borne by the Charterer; ② If switching is required due to force majeure (such as sudden meteorological disasters), the freight shall be settled according to the actual cargo quantity, and neither party shall pursue additional liability against the other.
5. 安全标准与责任界定(Safety Standards and Liability Definition)
5.1 无论启用哪套载重线,船舶消防、救生、通讯等设备配置均须符合船舶最大载重量对应的法定安全标准,船东对此承担举证责任。
5.1 Regardless of which set of load lines is used, the configuration of the ship's fire-fighting, life-saving, communication and other equipment must comply with the legal safety standards corresponding to the ship's maximum deadweight tonnage, and the Owner shall bear the burden of proof in this regard.
5.2 承租人不得要求船舶超出当前启用载重线的限制超载运输,否则因此导致的船舶损坏、港口处罚、航行事故等全部损失和法律责任,均由承租人承担。
5.2 The Charterer shall not require the ship to carry out overloaded transportation beyond the limit of the currently used load line; otherwise, all losses and legal liabilities such as ship damage, port penalties, and navigation accidents caused thereby shall be borne by the Charterer.
5.3 因船东原因(如证书失效、标志管理不当、未按规定完成切换核验)引发的合规风险或损失,由船东自行承担。
5.3 Compliance risks or losses caused by the Owner's reasons (such as invalid certificates, improper mark management, failure to complete switching verification in accordance with regulations) shall be borne by the Owner itself.
6. 特殊场景适配(Adaptation to Special Scenarios)
6.1 区域与季节适配:船舶航行于热带/夏季/冬季航区时,须按对应航区要求启用匹配的载重线,具体适配标准以载重线证书核定为准。
6.1 Regional and seasonal adaptation: When the ship sails in tropical/summer/winter navigation areas, it must use the matching load line in accordance with the requirements of the corresponding navigation area, and the specific adaptation standard shall be subject to the approval of the load line certificate.
6.2 淡水/海水适配:同一航区下,航行于淡水水域(密度1.000 t/m³)时启用淡水载重线,航行于海水水域(密度1.025 t/m³)时启用海水载重线,切换流程按本条款第3条执行。
6.2 Freshwater/seawater adaptation: In the same navigation area, the freshwater load line shall be used when sailing in freshwater areas (density 1.000 t/m³), and the seawater load line shall be used when sailing in seawater areas (density 1.025 t/m³). The switching process shall be implemented in accordance with Article 3 of this clause.
6.3 受限港口适配:针对明确限制船舶载重吨/吃水的港口,双方提前在航次指令中确认专用载重线及切换时间,船东须确保船舶靠泊前完成全部切换及核验流程。
6.3 Restricted port adaptation: For ports with clear restrictions on ship deadweight tonnage/draft, both parties shall confirm the special load line and switching time in the voyage instructions in advance, and the Owner shall ensure that all switching and verification procedures are completed before the ship berths.
